This Privacy Policy describes how Archer RE Inc. ("Archer," "we," "us," or "our") collects, uses, discloses, and protects information when you access or use our website at https://www.archer.re, our web-based platform at https://app.archer.re, and our related services, tools, and applications (collectively, the "Service" or "Services").

This Privacy Policy is incorporated into and subject to Archer's Terms of Use, available at https://www.archer.re/legal-disclosures. Capitalized terms used but not defined in this Privacy Policy have the meanings given to them in the Terms of Use or applicable Subscription Agreement (together, the "Applicable Agreements").

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree to this Privacy Policy, you must not access or use the Services.

1. Information We Collect

1.1 Information You Provide to Us

We collect information that you voluntarily provide when you register for an account, subscribe to the Services, or otherwise interact with us. This includes:

  • Account and Registration Information: Your name, email address, phone number, company name, job title, mailing address, and billing information.
  • Customer-Provided Data: Real estate property data you upload, input, or submit through the platform, including but not limited to General Property Data and Proprietary Data as defined in the Terms of Use. This may include rent rolls, trailing twelve-month operating statements (T12s), financial documents, investment strategies, transaction histories, tenant information, and other property-level data.
  • Subscription and Billing Information: Payment details, invoicing information, and transaction records related to your subscription.
  • Communications: Information you provide when you contact us for support, submit feedback, respond to surveys, or communicate with us by email or other channels.
  • User Preferences and Settings: Your platform configuration choices, custom charts of accounts, underwriting model preferences, deal pipeline settings, and notification preferences.

1.2 Information Collected Automatically

When you access or use the Services, we automatically collect certain information, including:

  • Usage Data: Information about how you interact with the Services, including features used, pages visited, underwrites completed, searches performed, documents parsed, and other platform activity. As described in the Terms of Use, Usage Data may be used for Archer Business Purposes.
  • Device and Connection Information: Your IP address, browser type and version, operating system, device identifiers, screen resolution, and referring URLs.
  • Log Data: Server logs that record requests made to our platform, including timestamps, access times, and error information.
  • Cookies and Tracking Technologies: We use cookies, web beacons, pixels, and similar technologies to collect information about your browsing activity. See Section 5 (Cookies and Tracking Technologies) for more information.

1.3 Information from Third Parties

We may receive information about you from third-party sources, including data providers that supply property-level, market, financial, and public record information that we incorporate into the Archer Platform and General Database, as well as analytics and advertising partners that help us understand usage patterns and reach potential customers.

2. How We Use Your Information

We use the information we collect for the following purposes:

2.1 To Provide and Operate the Services

  • Operating, maintaining, and improving the Archer Platform, including document parsing, underwriting automation, deal sourcing, comps benchmarking, asset management, and related features.
  • Processing and fulfilling your subscription and service requests.
  • Providing technical support and responding to your inquiries.
  • Managing your account, authenticating users, and administering access rights.

2.2 To Improve and Develop Our Products

Consistent with the Archer License granted under Section 5(F) of the Terms of Use, we may use Customer-Provided Data, following anonymization and aggregation, to update and improve Archer's products and services ("Archer Business Purposes"). This includes improving our data models, predictive analytics, automated underwriting algorithms, comps databases, and the General Database. Individual Customer-Provided Data is anonymized and aggregated before being used for these purposes, meaning it is not identifiable to any specific customer or property owner.

2.3 To Communicate with You

  • Sending transactional communications such as account confirmations, invoices, technical notices, security alerts, and support messages.
  • Sending informational communications about product updates, new features, industry insights, and events, where you have not opted out of receiving such communications.

2.4 For Analytics and Business Intelligence

  • Analyzing usage trends and patterns to understand how users engage with our platform.
  • Conducting internal research and generating aggregated, de-identified reports.
  • Measuring the effectiveness of our marketing campaigns and business development efforts.

2.5 For Legal and Compliance Purposes

  • Complying with applicable laws, regulations, legal processes, or enforceable governmental requests.
  • Enforcing our Applicable Agreements, including the Terms of Use and Subscription Agreements.
  • Detecting, preventing, or addressing fraud, security issues, or technical problems.
  • Protecting the rights, property, and safety of Archer, our users, and the public.

3. How We Share Your Information

We do not sell your Personal Data. We may share your information in the following circumstances:

  • Service Providers: We engage trusted third-party companies and individuals to perform services on our behalf, such as cloud hosting, data storage, payment processing, analytics, customer support, and email delivery. These service providers have access to your information only to perform these tasks and are contractually obligated to protect it.
  • Anonymized and Aggregated Data: As described in the Terms of Use, Archer may incorporate General Property Data into the General Database and use anonymized and aggregated Customer-Provided Data for Archer Business Purposes. Such data does not identify you or any specific property owner.
  • Business Transfers: If Archer is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will provide notice before your Personal Data is transferred and becomes subject to a different privacy policy.
  • Legal Obligations: We may disclose your information if required to do so by law, or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend the rights or property of Archer, prevent or investigate possible wrongdoing, protect the personal safety of users or the public, or protect against legal liability.
  • With Your Consent: We may share your information for any other purpose disclosed to you with your prior consent.

4. Data Retention

We retain your Personal Data for as long as your account is active, as needed to provide you the Services, or as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Upon termination of your access to the Services or your relationship with Archer, and subject to the Terms of Use (including Section 10(C) regarding destruction of materials), we will retain your information only as required for legitimate business purposes or as required by law. Usage Data is generally retained for a shorter period, except where it is used to improve the security or functionality of the Services or where we are legally obligated to retain it.

Data retention and disposal practices are subject to Archer's formal Data Retention Policy and Data Classification Policy, which define retention periods and handling requirements for different categories of information.

The Archer License, as described in the Terms of Use, survives termination and applies to anonymized and aggregated data and General Property Data already incorporated into the General Database.

5. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to collect and store information when you use the Services. These include:

  • Essential Cookies: Required for the operation of the Services, including user authentication, session management, and security. These cannot be disabled.
  • Functional Cookies: Allow us to remember your preferences and settings, such as login details, language preferences, and platform configuration choices.
  • Analytics Cookies: Help us understand how users interact with the Services by collecting information about pages visited, features used, and other engagement metrics. We use this information to improve the platform experience.

You can manage cookie preferences through your browser settings. Please note that disabling certain cookies may affect the functionality of the Services.

6. Data Security

We implement commercially reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, use, alteration, and disclosure. These measures include, but are not limited to:

  • Encryption of data both in transit (via SSL/TLS) and at rest using platform-managed cryptographic keys.
  • Logical access controls based on the principle of least privilege, with quarterly access reviews and prompt removal of terminated user access.
  • Intrusion detection and threat monitoring systems, including SIEM monitoring and infrastructure logging configured to alert appropriate personnel of anomalous activity.
  • Regular third-party penetration testing (at least annually) and vulnerability scanning (at least quarterly), with management review and remediation tracking of findings.
  • Formal incident response policies and a designated incident response team to identify, contain, remediate, and communicate security events.
  • Business continuity and disaster recovery plans with defined recovery point and recovery time objectives, tested at least annually.
  • Daily backups that are encrypted and stored separately from production systems.
  • Annual security awareness training for all employees, with background checks required as a condition of employment.
  • Use of compliance automation software (Drata) to support continuous monitoring and documentation of internal controls.

Archer RE, Inc. has completed a SOC 2 Type II examination conducted by an independent auditor (Johanson Group LLP) covering the trust services criteria for Security, Availability, and Confidentiality. The examination evaluated the design and operating effectiveness of Archer's controls. A SOC 3 report is available upon request.

Our critical infrastructure is hosted by Microsoft Azure and Amazon Web Services as subservice organizations. We require these providers, through contractual obligations, to maintain the confidentiality and security of customer information, and we review their compliance reports (SOC 2 or equivalent) at least annually.

However, no method of transmission over the Internet or method of electronic storage is completely secure. While we strive to protect your information, we cannot guarantee its absolute security. You are responsible for maintaining the confidentiality of your account credentials and for monitoring your account for unauthorized use.

7. International Data Transfers and Hosting

The Archer Platform is hosted in the United States on infrastructure provided by Microsoft Azure and Amazon Web Services, with multiple availability zones to provide redundancy and failover capability. If you access the Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.

By using the Services, you consent to the transfer of your information to the United States and agree to have your data processed in the United States, as stated in Section 10(E) of the Terms of Use.

8. Your Rights and Choices

8.1 Account Information

You may update, correct, or delete certain account information at any time by logging into your account or contacting us at support@archer.re. Please note that we may retain certain information as required by law or for legitimate business purposes, and that some data contributed to the General Database as General Property Data may be retained in accordance with the Archer License.

8.2 Marketing Communications

You may opt out of receiving promotional emails from us by following the unsubscribe instructions in those emails. Even if you opt out of promotional communications, we may still send you transactional and service-related communications.

8.3 California Privacy Rights (CCPA/CPRA)

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). These rights may include:

  • The right to know what Personal Data we collect, use, disclose, and sell or share.
  • The right to request deletion of your Personal Data, subject to certain exceptions.
  • The right to correct inaccurate Personal Data.
  • The right to opt out of the sale or sharing of your Personal Data. We do not sell Personal Data.
  • The right not to be discriminated against for exercising your privacy rights.

To exercise these rights, please contact us at support@archer.re or by mail at the address provided in Section 12. We will verify your identity before processing your request. If you are an authorized agent submitting a request on behalf of a California resident, we may require proof of authorization.

8.4 Other State and Jurisdictional Rights

Residents of other U.S. states with applicable privacy legislation may have similar rights. Please contact us at support@archer.re to submit a request, and we will respond in accordance with applicable law.

9. Children's Privacy

The Services are not directed to, and not intended for use by, anyone under the age of 18. Consistent with the Terms of Use, you must be at least 18 years old to use the Services. We do not knowingly collect Personal Data from anyone under 18. If we become aware that we have collected Personal Data from a person under 18, we will take steps to delete that information promptly. If you believe a minor has provided us with Personal Data, please contact us at support@archer.re.

10. Third-Party Links and Content

The Services may contain links to third-party websites, services, or content that are not owned or controlled by Archer. This Privacy Policy does not apply to third-party services, and we are not responsible for the privacy practices of any third party. We encourage you to review the privacy policies of any third-party services you access through or in connection with the Archer Platform.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, the Services, or applicable law. When we make material changes, we will notify you by posting the updated Privacy Policy on this page, updating the "Last updated" date, and, where appropriate, notifying you by email or through the Services. Your continued use of the Services after such changes constitutes your acceptance of the updated Privacy Policy.
